Terms of Service

Last updated: 2026-04-27

These Terms of Service ("Terms") govern your access to and use of the website, dashboard, and services (collectively, the "Service") operated by Mara Digiserv SRL, registered office: 1st Street, no. 207, Tautii Magheraus, MM, Romania, registration no. J24/89/18.01.2024, Fiscal code (CUI): 49433708 ("Company", "we", "us", "our").

By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1) The Service

We provide custom data extraction and web scraping services. Customers may submit requests describing target website(s), desired data fields, scope, frequency, and delivery format. We may provide samples, quotes, and deliver extracted data as files or other formats.

The Service may include one-time deliveries and recurring delivery plans (scheduled extraction runs).

Target websites can change at any time and may limit or block access; as a result, we do not guarantee that any particular website will be accessible or that specific data points will be available at all times.

2) Eligibility and accounts

You must be at least 18 years old and have the authority to enter into these Terms on behalf of yourself or your organization.

If you create an account, you are responsible for safeguarding credentials and for all activity under your account. Notify us promptly of any suspected unauthorized access.

3) Client responsibilities: legality and compliance

You are responsible for ensuring your requests and use of results are lawful.

You represent and warrant that you have all necessary rights, permissions, authorizations, and a valid legal basis to request scraping of the targets you submit and to use the resulting data, including when the data contains personal data.

We do not monitor, evaluate, or verify whether you are permitted to extract data from a specific website or whether your intended use of scraped data is lawful. We rely on your representations and instructions.

You agree to comply with applicable laws and regulations in connection with (a) your scraping requests and targets and (b) your use, storage, sharing, and processing of any extracted data and result files we deliver to you. This includes privacy and data protection, consumer protection, anti-spam, intellectual property laws, and database rights (including, where applicable, sui generis database rights), as well as any lawful contractual obligations you may have.

4) Prohibited use

You must not use the Service to:

  • Violate any law or third-party rights (including through unlawful scraping or unlawful use of scraped data).
  • Attempt unauthorized access to systems (for example, by using credentials you are not authorized to use or by exploiting vulnerabilities).
  • Collect, use, share, or otherwise process personal data in violation of applicable data protection laws, or process special category data without appropriate safeguards and a lawful basis where required.
  • Conduct denial-of-service activity, credential stuffing, or similar abusive behavior.
  • Upload malicious files or attempt to compromise the Service.
  • Resell, rent, or provide access to the Service to third parties without our prior written consent, unless explicitly permitted.

We may refuse, pause, or terminate work or access if we believe a request creates undue legal, technical, or reputational risk.

5) Requests, deliverables, and acceptance

You are responsible for providing accurate request details (targets, scope, fields, format, schedule). We may ask clarifying questions before confirming scope, timeline, or pricing.

Deliverables are typically the final processed output files we provide to you, unless agreed otherwise in writing. Deliverables may be made available via your dashboard, by email, or via another delivery method we agree on. We may store raw and processed outputs as part of the workflow.

File availability and retention: Delivered files are available for download for a limited period (currently 180 days from delivery, unless agreed otherwise in writing). After that period, files may be deleted from our storage without further notice, and you are responsible for downloading and backing up deliverables during the availability period.

Acceptance window: You must review deliverables and report any issues within 7 days after they are made available in the dashboard, sent by email, or otherwise delivered to you. "Issues" means material non-conformity with the agreed scope/specifications. If you do not report issues within this period, deliverables will be deemed accepted, unless we agree otherwise in writing. Requests for changes outside the agreed scope may require a new quote and additional fees.

For evaluation, we may provide sample previews via private links. Sample data is provided for evaluation only and may be limited, expire, or be revoked.

6) Fees, billing, and payments

Pricing is typically custom based on scope, complexity, volume, and schedule. Unless explicitly agreed in writing, estimates are non-binding.

Estimated timelines are approximate and may change due to target website changes, access restrictions, client-side delays, or clarification requests.

Recurring services: If we agree to provide recurring extraction services, we will perform scheduled extraction runs and deliver outputs as described in the applicable quote, order, or written agreement. Unless otherwise agreed, recurring services are billed periodically by payment request after the relevant services are provided. Recurring services continue until cancelled by either party before the next scheduled service period.

Plan cancellation: You may cancel a recurring plan by emailing us at [email protected]. Cancellation takes effect at the end of the current billing period unless we agree otherwise in writing. Any fees for services already delivered or performed before the cancellation effective date remain due. Except as required by law, we do not provide prorated refunds for partial billing periods.

Order cancellation (one-time orders): You may request cancellation of a one-time order by emailing us at [email protected]. If cancellation is requested before work starts and we confirm the cancellation, no service fee is due except any prepayment or deposit that we have expressly agreed is non-refundable. If work has already started, or if any deliverables have already been provided, fees for work already performed remain due. Cancellation is effective when we confirm it in writing.

Target website changes or unavailability: Target websites may change, restrict access, block requests, or otherwise become unavailable at any time. If a target website becomes inaccessible and we cannot deliver scheduled result files for that target, we will not charge you for the missing result files. If a plan covers a single target website and we cannot reasonably restore delivery, we may stop the plan (and you will not be charged for future billing periods). If a plan covers multiple targets and one or more targets cannot be delivered, we will reduce the plan price to reflect the missing deliverables and communicate the adjustment.

Payment requests and due dates: We may issue invoices or payment requests for work performed or to be performed. Payment is due by the due date stated on the invoice/payment request (or, if no due date is stated, within 7 days after we send it to you).

For most projects, we issue a payment request first and issue the fiscal invoice after payment is received, unless applicable law requires a different timing.

We may require prepayment, a deposit, or milestone-based payments at our discretion.

Payments may be processed via third-party payment processors and/or banking partners (for example, card payments or bank transfer, where applicable). You authorize us and our payment providers to charge or process payments according to the selected method. Available methods may vary, and we may require a specific payment method for a given invoice or request.

Non-payment: If payment is not received when due, we may pause or stop work, suspend account access, and/or disable access to deliverables until payment is received, where legally permitted. If you do not pay applicable fees when due, you agree to promptly stop using the deliverables and, where feasible and legally permitted, delete or destroy any copies in your possession or control, and we may request written confirmation.

Failed payments, disputes, and chargebacks: If a payment fails, is reversed, or is disputed (including via a chargeback), we may suspend access while investigating. You agree to contact us promptly to resolve billing issues in good faith. You may be responsible for reasonable costs and fees incurred as a result of chargebacks or payment reversals, where permitted by law.

You are responsible for applicable taxes, duties, and fees (including any bank fees for transfers), unless stated otherwise.

Taxes and fiscal invoices: Prices may be stated exclusive of VAT or other applicable taxes unless explicitly stated otherwise. You agree to provide accurate billing details (including VAT/tax identifiers where applicable). We issue fiscal invoices or equivalent tax documents where required under applicable law.

Refunds: Except as required by applicable law (including any applicable consumer withdrawal rights), fees are non-refundable, particularly for customized services and work that has already been performed. We may, in our sole discretion, issue refunds or credits on a case-by-case basis.

7) Right of withdrawal (EU/EEA/UK consumers)

This section applies only if you are a consumer in the EU/EEA or the United Kingdom (that is, you are acting for purposes outside your trade, business, craft, or profession). If you are contracting as a business, this section does not apply.

Withdrawal right: Where applicable, you may have a statutory right to withdraw from a distance contract within 14 days from the date the contract is concluded, without giving any reason.

When the contract is concluded: The contract is typically concluded when we accept your order/request (for example, by confirming it in writing by email or in the dashboard).

How to exercise: To exercise a withdrawal right (where applicable), you must inform us of your decision by a clear statement (for example, by email). To meet the withdrawal deadline, it is sufficient for you to send your communication before the withdrawal period has expired.

Contact us via the contact form or email [email protected] and state your decision to withdraw.

Starting work during the withdrawal period: If you ask us to begin providing the services during the withdrawal period, you may be required to pay for services provided up to the time you withdraw. If the services have been fully performed at your express request within the withdrawal period, you may lose the right to withdraw, to the extent permitted by applicable law. Where required, we may ask you to confirm your request/consent to start during the withdrawal period and your acknowledgement that the right to withdraw may be lost once the services are fully performed.

Effects of withdrawal: If you withdraw and you have made payments in advance, we will reimburse payments received from you without undue delay and in any event within 14 days from the day on which we are informed of your decision to withdraw. We will use the same means of payment you used for the initial transaction unless you have expressly agreed otherwise. If you requested us to start providing the services during the withdrawal period, we may deduct an amount proportionate to the services provided up to the time you informed us of your decision to withdraw, where permitted by applicable law.

8) Intellectual property

We and our licensors retain all rights to the Service, including its software, templates, site content, and branding. You may not copy, modify, distribute, or reverse engineer the Service except as permitted by law.

You retain rights to the materials you provide to us. Subject to payment of applicable fees, you may use the deliverables we provide to you, to the extent permitted by law. Deliverables may include third-party content or data derived from third-party websites, and your rights may be limited by third-party rights and applicable law; you are responsible for ensuring your use is lawful. Except to the extent such rights exist under applicable law or the target's terms, we do not grant you any license to third-party source content itself. We may use and store your inputs and deliverables only as necessary to provide the Service and to comply with legal obligations.

9) Confidentiality

We will treat non-public information you provide as confidential and use it only to provide the Service, except where disclosure is required by law or necessary to engage subprocessors (for example, infrastructure providers) under confidentiality obligations.

10) Disclaimers

The Service is provided "as is" and "as available". We do not warrant uninterrupted availability or that any scraping target will remain stable, accessible, or complete.

Data accuracy: We make reasonable efforts to extract data accurately, but we do not guarantee that extracted data will be complete, error-free, or up-to-date. Websites can contain errors, change frequently, and present inconsistent data. You are responsible for verifying fitness for your use case.

11) Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenues, data, or goodwill arising from or related to the Service.

Liability cap: To the maximum extent permitted by law, our total liability for any claim arising out of or relating to the Service will not exceed the amount paid by you for the specific order or recurring delivery giving rise to the claim.

We are not responsible for your unlawful use of scraped data or for disputes between you and third-party websites or platforms.

Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable law.

12) Indemnification

You agree to defend, indemnify, and hold us harmless from and against claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your targets, instructions, use of outputs, or violation of these Terms or applicable law.

13) Termination

We may suspend or terminate access to the Service if we believe your use violates these Terms, is unlawful, or creates undue risk. You may stop using the Service at any time.

Upon termination, access to the dashboard and stored files may be limited, and retention policies may apply.

14) Changes to these Terms

We may update these Terms from time to time. The "Last updated" date indicates when the latest changes were made. Continued use of the Service after changes become effective constitutes acceptance of the updated Terms.

15) Miscellaneous

  • Severability: If any provision is found unenforceable, the rest remains in effect.
  • No waiver: Failure to enforce a provision is not a waiver of the right to enforce it later.
  • Assignment: You may not assign these Terms without our written consent; we may assign as part of a merger, acquisition, or reorganization.
  • Force majeure: We are not liable for delays caused by events outside our reasonable control.
  • Entire agreement: These Terms, together with any project-specific quote, order, statement of work, or other written agreement we provide and you accept, constitute the entire agreement between you and us regarding the Service and supersede prior or contemporaneous proposals, discussions, and communications on that subject.
  • Order of precedence: If there is a conflict between these Terms and a written quote, order, statement of work, or other project-specific agreement we provide and you accept for a specific request, the project-specific document will control for that request.

16) Complaints and consumer dispute resolution

If you have a complaint, please contact us first and we will try to resolve it promptly and in good faith.

Depending on your location and status (consumer vs. business), you may have access to alternative dispute resolution (ADR) services in your country. In particular, if you are an eligible consumer resident in the EU/EEA/UK, ADR options may be available under applicable consumer ADR rules. If applicable, eligible consumers may also use the Romanian ADR platform operated by ANPC (SAL) for consumer disputes with us, subject to the platform's scope and procedural rules: https://anpc.ro/ce-este-sal/.

Note: The EU Online Dispute Resolution (ODR/SOL) platform was discontinued on July 20, 2025.

17) Governing law

These Terms are governed by the laws of Romania, without regard to conflict of law principles. Courts located in Romania will have jurisdiction over disputes arising out of or relating to these Terms, unless mandatory law provides otherwise.
